Is your organization in compliance with the Overpayment Rule? On March 14, 2016, the final rule regarding provider and supplier obligations for reporting and returning Medicare Part A and B overpayments became effective. This rule is important to post-acute providers because it spells out the obligation providers have to use “reasonable diligence” to “identify” and quantify Medicare Part A and B overpayments and repay them to the government. The rule also makes it clear that overpayments must be reported and returned within 60 days of identification or they will be treated by the government as a False Claim. Providers and their Boards need to be educated on this final rule now, and providers need to establish and/or revise their policy and procedures for identifying and returning overpayments in accordance with this final rule.
