Yesterday, the Ohio Department of Medicaid filed a motion to dismiss as moot the mandamus action brought forward by LeadingAge Ohio and co-plaintiffs the Ohio Healthcare Association (OHCA) and the Academy for Senior Health Sciences. The motion to dismiss argues that the new budget bill makes the action moot.
Notably, while a subsequent budget bill (HB 96) has passed, that bill made no changes to the Ohio Revised Code language that is the subject of the mandamus action; the disputed language remains in effect.
